DHS: We Have the Authority to Routinely Strip-Search Air Travelers

 
   
The Department of Homeland Security told a federal court that the agency believes it has the legal authority to strip-search every air traveler. The agency made the claim at oral argument in EPIC's lawsuit to suspend the airport body scanner program. The agency also stated that it believed a mandatory strip-search rule could be instituted without any public comment or rulemaking. EPIC President Marc Rotenberg urged the Washington, DC appeals court to suspend the body scanner program, noting that the devices are "uniquely intrusive" and ineffective. EPIC's opening brief in the case states that the Department of Homeland Security "has initiated the most sweeping, the most invasive, and the most unaccountable suspicionless search of American travelers in history," and that such a change in policy demands that the TSA conduct a notice-and-comment rule making process. Idaho House First to Nullify ObamaCare

On Wednesday, February 16, the Idaho House became the first state legislative body to pass a measure to nullify the entire ObamaCare law within a state.
The measure, HB117, was sent to the state Senate by a vote of 49-20. Only seven Republicans voted against the bill along with all of the House Democrats.
The Associated Press reported:
Idaho's bill declares the federal Patient Protection and Affordable Care Act unconstitutional and forbids enforcement of penalties against residents. It also prohibits Idaho state and local governments from enforcing the federal law and also bars them from taking federal money — or using their own resources — to put the measure into effect.
According to the bill's sponsor, Rep. Vito Barbieri: "The bottom line is, we're directing the state agencies to stop spending time and money."
