Republicans Faithfully Block Constitution Party From "Free and Equal" Ballot Access

Picture The Republican Party has succeeded in preventing the Constitution Party from representation on the ballot in Pennsylvania this November. Do you remember the colonists cry of taxation without representation?

Following a day plus of signature validation efforts by Constitution Party members and supporters, it became obvious that the whole process was not going well for the Constitution Party. During lunch on the second day, members and supporters met in private to discuss the numbers (i.e. the odds) of winning this battle. The Attorney for the Constitution Party consulted each member for their input. Many felt their numbers were improving significantly over the first day since they now knew more about the process. It was agreed upon to continue till the end of the day, reconvene and review the updated numbers before making a final decision.

Approximately an hour later, Constitution Party members were approached individually by their attorney and informed that they had been given an ultimatum from the Republicans: They had to either concede to the Republicans by 3:00 in the afternoon or they would start assessing their costs on the Constitution Party. They were told these costs could very easily exceed $100,000.00. Each Constitution Party member was then asked for their vote and invited to reconvene in private at 3:00pm for the results. At this meeting, Jim Clymer, Vice-Presidential candidate for the Constitution Party, relayed the bad news. Words of wisdom along with expressions of thanks and appreciation were given and received by all. The shedding of tears and the holding back of tears was evident around the room.

Pennsylvania, you have not only lost the chance to vote for more options; you have lost more of your precious liberty. Likewise, you have lost the ideas these candidates were bringing to the table; ideas which could have made for a better Pennsylvania. Now they have been struck from the political debate.

America, where is thy Liberty and why has she fled? Constitutional Patriots stand united in beckoning her return. With humble prayers, many plea before their Creator. They plea for the wisdom and strength to hasten her restoration. We uphold a vision of that glorious day when peace and liberty will be afforded to all. We pledge to continue this struggle despite any obstacle which the destroyer of liberty may throw across our path.

Republicans Challenge Pennsylvania Petitions of Libertarian and Constitution Parties

On August 8, two attorneys working for various Republican Party officials filed challenges to the validity of the Libertarian Party statewide petition and the Constitution Party statewide petition. No challenge was filed against the statewide Green Party petition.
Fortunately, also on August 8, Oliver Hall filed a request for injunctive relief in federal court against the Pennsylvania challenge system. That case, which was filed on May 17, 2012, is called Constitution Party v Aichele, eastern district, 5:12-cv-2726. Here is the filing. Here are the exhibits that accompany that filing. Oliver Hall is the attorney for the Constitution, Green, and Libertarian Parties in that case. A previous case filed in 2009 had resulted in a decision that the plaintiffs lack standing. In this instance, it appears logically impossible that anyone could think the Libertarian Party, or the Constitution Party, now lack standing. Without relief from the federal court, the Libertarian and Constitution Parties are placed in the dilemma of either withdrawing their petitions, or risking a judgment that court costs of perhaps $100,000 or more are owed to the challengers.
One of the attorneys who filed the challenge to the Libertarian and Constitution Parties is the same attorney who challenged the minor party statewide petitions in 2010, and who warned the parties that court costs might be as high as $110,000. In 2010 all the statewide minor party petitions were then withdrawn and no one ever determined whether they had enough valid signatures or not.

FOUNDING FATHERS GREAT GARDENERS PICNIC

All freedom-lovers are invited to the Freedom Garden picnic to celebrate what we all crave so dearly … to celebrate what drove our Founding Fathers to strike out on their own  …  FREEDOM!   With battle lines drawn in the dirt of our backyards, patios, or whatever available place, we will take the WWII Victory Garden to even greater heights.  Americans still have a strong connection to the land.  It resonates with the idea of freedom. 
George Washington, James Madison, Thomas Jefferson, and Ben Franklin all shared an extensive interest in farming.  Frankly, we’d have loved to be guests at the Washington, Jefferson, Franklin, and Madison family tables.  You may know that Thomas Jefferson’s favorite food was macaroni and pea salad.  There was actually something that James Madison loved to eat.  Madison loved ice cream.  Washington, the Father of Our Country enjoyed nuts and cherries.  Ben Franklin had a yen for pickles.  It all sounds good to us so we will be providing some of these favorites in addition to the All-American favorite, the hot dog.  Bring one of your favorite picnic foods to share and come and enjoy an afternoon of games, speakers with important messages, and join together in a homegrown revolution.

When in the Course of human events it becomes necessary for one people to dissolve the political bands which have connected them with another and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.
We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, — That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Pennsylvania Asks for More Time to Respond to Minor Party Ballot Access Lawsuit

June 20th, 2012 As noted earlier, on May 17, the Constitution Party, the Green Party, and the Libertarian Party had filed a lawsuit in U.S. District Court in Philadelphia against the unique Pennsylvania system that requires petitioning candidates and groups to be subject to as much as $100,000 in court costs, if their petitions are held to lack enough valid signatures. That case is Constitution Party of Pennsylvania v Aichele, 5:12-cv-2726.
The state has just asked for, and obtained, a 30-day extension to answer the complaint. The state’s answer is now due July 25

On May 17, the Pennsylvania Constitution, Green, and Libertarian Parties filed a new federal lawsuit against the Pennsylvania system for checking petitions. The system, ever since 2004, has put petitioning candidates in jeopardy of paying court costs of up to $100,000 if their petitions are found to lack enough valid signatures. The case is in the eastern district, in Philadelphia. Here is the complaint.
The case, Constitution Party of Pennsylvania v Aichele, 5:12-cv-2726, was assigned to Judge Lawrence Stengel, the same U.S. District Court judge who ruled in a similar case in 2009 that the plaintiff parties lack standing. This time, the complaint has been designed to withstand that peril.
Pennsylvania and Alabama are the only states in which no statewide minor party or independent candidates appeared on the ballot in any non-presidential election year, during the period 2005 to the present. All the statewide minor party petitions filed in 2010 in Pennsylvania were withdrawn after major party leaders threatened to challenge those petitions. In 2006, the only statewide petition submitted by a minor party or independent candidate was the Green Party petition, and the party’s U.S. Senate nominee, Carl Romanelli, was ordered to pay over $80,000 when that petition was found lacking in enough valid signatures. The only statewide minor party or independent petitions that have succeeded in Pennsylvania in the last seven years are the 2008 Libertarian petition and the 2008 independent Ralph Nader petition.

Jim Clymer Nominated for Vice-President by Constitution Party

Jim Clymer Nominated for Vice-President by Constitution Party Lancaster, PA--Lancaster attorney Jim Clymer was tapped by Constitution Party Presidential nominee, Virgil Goode of Virginia to be his running mate at the Constitution Party National Convention held last weekend in Nashville, Tennessee.  The selection was overwhelmingly ratified by the convention.

Goode, a six-term US Representative from the 5th District of Virginia, who previously had spent 20 years in the Virginia State Senate was nominated on the first ballot by the Constitution Party delegates on Saturday with 203 votes out of a total of 403 votes cast.  Clymer, who served 12 years as Constitution Party National Chairman, ran for US Senate in Pennsylvania in 2004, Lancaster County Commissioner in 2003 and in 1998 was the Lt. Governor running mate of the dynamic Peg Luksik.  He is the senior Partner in the Law firm of Clymer, Musser & Conrad, PC in Lancaster.

The Constitution Party held its National Convention in Nashville, Tennessee on April 18-21, 2012. Many important events transpired at the National Convention. One important event that took place was that of the Nomination of the Constitution Party Candidate for President and Vice President of the United States. 2012 marks a very important and significant year for our country. There may never be an important election like this ever again. So, that is why we must unify ourselves under one candidate who can and will get the job done.
The candidates that presented themselves in order to be the Constitution Party Nominee for President of the United States were Former U.S. Congressman Virgil Goode, Former College Coach Robby Wells, 2008 Vice Presidential Candidate Darrell Castle, Susan Ducey and Radio Show Host Laurie Roth. It was a close race for the nomination. A total of 403 delegate votes were available to be cast at the Convention. A majority of 202 delegate votes were needed to clinch a win to be the eventual nominee.

We are heading into the month in which the Constitution Party will hold its National Convention in Nashville, Tennessee. We have a great fight ahead of us. We face a nation that begs for more choice, more options and more freedom while at the same time this same nation also takes away those choices, options and freedoms from its people. That is why we, The Constitution Party, must continue to fight to preserve these freedoms that are still intact and ensure that the citizens of the United States have a third or fourth choice every time they go to the polls.

JBS meeting to discuss Agenda 21

There will be a John Birch Society meeting at the( Panera Bread Restaurant in Monroeville PA  Penn Center
400 Penn Center Boulevard Pittsburgh, PA 15235 Phone: (412) 816-5820) on Thursday March 29th starting at 7:00 PM. This is a change from our usual schedule of the 2nd & 4th Thursdays meetings, the reason for the change is to accommodate the schedule of our district Field Coordinator Mr. Tom Rice.   ( This Panera Bread is west of the Monroeville Mall NOT in the Miracle Mile Shopping Center)
Mr Rice will be in attendance and have a presentation for us regarding the current topics & projects that the Society is focused upon and our role in these projects.His main message will be about Agenda 21 and there will be a video on that topic.
I am hoping since this location is easier for many to get to rather than Blawnox, that many of our friends & curious patriots from Westmoreland county & the surrounding area may be in attendance. This meeting is absolutely open to everyone interested and I would encourage everyone attending to bring a friend.

Virginia strikes back at NDAA!!

Del. Bob Marshall, of Virginia, called me last night. The reason will excite you. He wanted to thank me for the role DownsizeDC.org played in achieving a major victory.
Mr. Marshall's bill, HB 1160, has passed BOTH houses of the Virginia legislature, including a 39-to-1 vote in the Senate this past Tuesday. This bill prohibits the state of Virginia from assisting the federal government in the unlawful detention of United States citizens. Remember . . .
The Executive Branch gained this power of "kidnapping" as a result of a confusing provision in the 2012 National Defense Authorization Act (NDAA). That criminal statue contained tricky language that has fooled many reporters, citizens, and even members of Congress. The measure was deceitfully written to make people think it exempts U.S. citizens when it does NOT! This linguistic deceit was likely intentional. But it's even more important to defend the principle that citizenship is morally irrelevant, because . . .

Voting for officers

At our March 20th meeting we will be voting for officers in the Constitution Party of Allegheny County. If you are interested in voting or being an officer, you must be there for this meeting. In order to vote you have to be a registered member of the Constitution Party. We will have a list from the county, but if you switched recently you will need your voter I.D. card to show that you are a member. Come on out and get involved!!

Pa state convention report

Saturday the Constitution Party held its state convention at the Park Inn in Harrisburg. The topic of the meeting was sorting out national delegates and voting for state officers. There were nine delegates chosen so far to be delegates at the April national convention in Nashville TN. Some new state officers were also named. Wes Thompson stepped down as chairman and Joe Murphy was elected to fill the position. For vice chairman Robert Nulton was elected and the secretary and treasurer remained in Donna Fike and Jim Clymer. There is a big push for signatures this year to get our presidential and statewide candidates on the ballot. No other significant business was addressed.

PITTSBURGH – County Executive Rich Fitzgerald issued the following statement in response to the announcement by the United States Air Force of plan to close the 911th Airlift Wing in Moon within the next two years:
“I was extremely disappointed to hear the announcement today by the Air Force regarding the 911th.  This unit has been a vital part of our community, includes over 1,220 members, provides employment for over 300 civilians and provides tactical airlift support to members of our Armed Forces.  I intend to work closely with our Congressional delegation to answer this proposal and fight to keep the 911th Airlift Wing open, operating and protecting our region.”

This is happening while the Obama administration continues to open bases around the world. The Obama policy is just a continuation of the former Bush administration. National Popular Vote Initiative

Whereas the National Popular Vote Initiative is an attempt to amend the United State’s Constitution without going through the amendment process; and 

Whereas the National Popular Vote Initiative is a strategy to thwart and nullify the concepts and principles underlying the Electoral college; 

Be it resolved that the Constitution Party of Pennsylvania hereby declares its opposition to the National Popular Vote Initiative and opposes any requirement that Pennsylvania’s Electors in the Electoral College vote for a presidential candidate who did not receive the highest vote count in the Commonwealth of Pennsylvania in the immediately preceding Presidential popular vote election.

State of the Union Address 2012 response

 


The President of the United States said many great things that the people want to hear. Yes, the people want to hear what is and what could be and what may be but, now let's see all of this happen. We, as Americans, have gone on long enough without seeing action. We deserve to see our government work for us and with us instead of making us work for them. There are still hundreds of thousands to millions of Americans out of work. Jobs and the economy still does not seem to be the focus of this President. The government should not be in the business of Education. They should only be in the business of protecting our country and securing our borders.

Terrorism and Personal Liberty, from the CP platform

The Bill of Rights is the first 10 amendments to the Constitution.
Because we will refer to the fourth and fifth amendments, let's read them in their entirety:

Amendment IV:
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Amendment V:
"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."
Note there is no exception to these rights provided for war or public danger.

Article 1, Section 9, Clause 2: "The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."
The threat of Terrorism has not been claimed to be a rebellion or an invasion.

The Constitution Party of Pennsylvania Spring Convention 2012

This will be a very important Meeting as we prepare for the National Convention in Nashille, Tennessee.
We will have the election of State Officers and
it will also be the kick-off for Pennsylvania's Ballot Access Drive.

Tentative Schedule

Executive Committee Meeting 10:00am – Noon
State Convention 1:00pm

Business to be addressed:
  • Election of State Officer
  • Petitions for 2012 Election
  • Preparation for National Meeting in April
  • Presentation by Paul Rabanal of L.I.F.E team-biz

Evening Banquet  5:30pm

Guest Speaker Presentation following the Banquet:
Lourdes Swartz of the Pennsylvania Family Coalition

Cost is $35.00 for banquet and use of the facilities
If you want to have voting privileges at this Convention, Annual Dues
of an additional $35 must be paid to The Constitution Party of Pennsylvania.

These payments will be accepted at the door.
